Default Can you pull out of a deal on eBay?

I won an auction the other day for a lcd tv and now I'm having second thoughts. Am I locked into this deal or can I cancel it? I know there is a cooling off part of some contracts allowing someone to walk away from a deal - does this apply to eBay?

If you won the item via Buy it Now rather than auction then yes, you are covered by Distance selling regulations which allow a cooling off/cancellation period in the first 7 days after sale.

The best thing would be to contact the seller and explain to them that your circumstances have changed.

Have you paid for the item yet? Does the seller look like they re a business (how much feedback do they have)?

It was not a Buy It Now sale but it was a business I bought it from so I'm a bit stumped.

Nope, your not stumped. Distance selling regulations apply to businesses, whatever on-line selling method is applied. This is the law, whatever it says on eBay.

Also, sellers cannot give buyers any feedback postive or negative these days on eBay.

Are you sure? I know a seller can't leave negative feedback but I am pretty sure they can leave positive.

Sellers can leave positive feedback, they can't leave negative any more.

However, they can complain to eBay about the buyer, who could take action if necessary.

You should be OK within 7 days (?) of the purchase, to cancel it if you're unsure, and you should have no comeback from the seller....

You can back out. not morally or probably even legally, but you can back out. I've had two buyers do it to me on E f***ing Bay. In both cases their tactic was to ignore all communication from me and from Ebay.

No-one can come round and force you to buy something, and it's most unlikely that you'd be taken to any kind of court for breach of contract. So yeah - if you want to be a bit of a dingbat, apologise profusely to the seller and cancel. If you want to be a complete dipsh!t don't do anything more. You'll get a black mark from EBay though, as if that matters to anyone these days.

If you want to do it the right way, offer to pay the seller's costs.
